Terms of Sales

These conditions of sale are concluded on the one hand by SAS Yasmantom (owner of the online store: https://www.laquille974.com/), represented by Mr Emmanuel Michau, whose registered office is 192 rue Marius et Ary Leblond, 97460 Saint Paul, hereinafter referred to as "Seller" and on the other hand, by any natural person over the age of 18 or legal entity wishing to make a purchase via the website "www.laquille.com" hereinafter referred to "the Buyer".

Object

These general conditions of sale are intended to define the contractual relationship between the Seller and the Buyer and the conditions applicable to any purchase made through the Seller's merchant site, whether the Buyer is a professional or a consumer. The acquisition of a good or a service through this site implies unreserved acceptance by the Buyer of these conditions of sale.

These conditions of sale shall prevail over any other general or specific conditions not expressly approved by the Seller. The Seller reserves the right to be able to modify its conditions of sale at any time. In this case, the applicable conditions will be those in force on the date of the order by the Buyer.

Characteristics of the goods and services offered

The products and services offered are those listed in the catalog published on the Seller's website. These products and services are offered within the limits of available stocks. Each product is accompanied by a description drawn up by the supplier; for some of them, the Buyer may have access to the supplier's documentation.

The photographs in the catalog are as faithful as possible but cannot ensure perfect similarity with the product offered, particularly with regard to colors.

Prices

The prices appearing in the catalog are prices including VAT in euros and the VAT in force (VAT Reunion 8.5%) is included in the price; any change in the rate may be passed on to the price of the products or services. The Seller reserves the right to modify its prices at any time, it being understood, however, that the price appearing in the catalog on the day of the order will be the only one applicable to the Buyer. The prices indicated on each product do not include order processing, transport and delivery costs provided that they take place in the geographical areas provided for below. It is only before the payment of the complete order that you will have the final price including the additional costs!

Geographical area

The online sale of products and services presented on the site is reserved for buyers who reside or visit Reunion Island.

Orders

The Buyer, who wishes to buy a product or service must:

- complete the online order form giving all the references of the products or services chosen;

- validate his order after having checked it;

- make the payment under the conditions provided;

- confirm their order and payment. Confirmation of the order entails acceptance of these conditions of sale, acknowledgment of having perfect knowledge of them and waiver of its own conditions of purchase or other conditions. All the data provided and the recorded confirmation will constitute proof of the transaction. Confirmation will be worth signing and acceptance of transactions. Seller will communicate by e-mail confirmation of the registered order.

Withdrawal

The Buyer has a period of withdrawal from his order, of fourteen (14) working days from the date of ordering the products. This being as we market food products, for reasons related to hygiene, the withdrawal may be refused by our customer service.

It is he alone who will decide.

The Buyer exercises his right of withdrawal by sending a registered letter with acknowledgment of receipt to the Seller, within fourteen (14) days. The Buyer then has fourteen (14) days to return his product, after approval by customer service.

The Buyer is then reimbursed for the price of the order, by any means of payment, the Seller may defer reimbursement until the product is recovered. Any order paid for by credit notes/gift vouchers will be refunded in the form of a credit note.

The Buyer has the obligation to return the product in good condition, under conditions specific to its re-marketing.

The Customer's right of withdrawal cannot be exercised when the Buyer has ordered products and the product has been used or opened.

Payment terms

The price is payable when ordering.

Payments will be made by credit card, or Paypal they will be made through the secure system provided by Paypal and which uses the SSL (Secure Socket Layer) protocol so that the information transmitted is encrypted by software and that no third party cannot read it during transport on the network.

The Buyer's account will only be debited upon validation of the payment.

At the Buyer's request, he will be sent a paper invoice showing the VAT.

Deliveries & collections

Removal directly from La Quille, located at 192 rue Marius & Ary Leblond, 97460 Saint Paul, is possible, no deliveries are made. The Buyer will ask when placing his order, a day and time of removal which will be confirmed and validated by the Seller, before the removal.

Guarantee

All the products supplied by the Seller benefit from the legal guarantee provided for by articles 1641 and following of the Civil Code. In the event of non-compliance of a product sold, it may be returned to the seller who will take it back, exchange it or refund it. All complaints, requests for exchange or reimbursement must be made by e-mail to the following address: contact@laquille974.com within seven days of delivery.

Responsibility

The Seller, in the online sales process, is only bound by an obligation of means; its liability cannot be engaged for damage resulting from the use of the Internet network such as loss of data, intrusion, virus, service interruption, or other involuntary problems. Intellectual property All elements of the Seller's site are and remain the exclusive intellectual property of the Seller.

No one is authorized to reproduce, exploit, redistribute, or use for any purpose whatsoever, even partially, elements of the site whether software, visual or sound. Any simple or hypertext link is strictly prohibited without the express written consent of the Seller.

Personal data

In accordance with the law "Informatique et Libertés" n ° 78-17 of January 6, 1978, the Buyer has a right of access and rectification of the data concerning him, and can exercise this right by sending an email, indicating his surnames, first names and addresses, at the following address: contact@laquille.com

Information of a nominative nature relating to buyers may be subject to automated processing. The Seller reserves the right to collect information on Buyers, including by using cookies, and, if desired, to transmit the information collected to business partners.

Buyers may object to the disclosure of their details by notifying the Seller.

Archiving - Proof

The Seller will archive the purchase orders and invoices on a reliable and durable medium constituting a faithful copy in accordance with the provisions of article 1348 of the Civil Code. The Seller's computerized registers will be considered by the parties as proof of communications, orders, payments and transactions between the parties.

Litigation

These online sales conditions are subject to French law. In the event of a dispute, jurisdiction is assigned to the competent courts of the jurisdiction of Saint Denis de la Réunion, notwithstanding multiple defendants or warranty claims.
